Class action suit possible against Mobclix for not paying indie developers

by Jeff Sherk

UPDATE May 18, 2013:
If you have not been payed by Mobclix and are interested in a Class Action suit then you need to go the following site:
http://www.mobclix-pay.us/

UPDATE April 30, 2013:
As of April 30, 2013 we have over $500,000 claimed as owing to the developers that have posted in the comments below, as well as another developer that told me he is owed over $100,000. However a couple days ago I received a check from Mobclix for the full amount owing to me, so obviously I am no longer going to need to be involved in a class action suit. But in order to facilitate the rest of you that still have an issue, please join:
(1) Mobclix Pay Us website: http://www.mobclix-pay.us/
(2) Skype group:
mobclixclassaction
(3) Google group: https://groups.google.com/forum/?fromgroups#!forum/mobclix-class-action
At the bottom of this post, I also added a sample copy of the letter and the invoice that I sent to Mobclix on April 1st. You can use these as a template if you want. Please note that I am not promising this will work and there is no guarantee it will work… I am simply sharing what worked for me.

WARNING:
If you press them for the money they owe you, they may DISABLE your account. Here is the email response I received:
I have a payment ready to be sent out for your account. Please provide us with a mailing address. We will also be turning off ad serving as well and disabling your account.
So make sure you have removed Mobclix SDK from your apps before you start to chase them for your money.

ORIGINAL POST…

Mobclix Inc (mobclix.com) is a mobile ad exchange network that was acquired by Velti (NASDAQ: VELT) in 2010. And I highly recommend you do NOT use them, because they won’t pay you!

As a game publisher, I integrated the Mobclix publisher SDK in some of my games last year (May 2012) in order to show banner ads to my users. Mobclix is then supposed to pay me for the ads impressions and ad clicks that I deliver in my games. Their Terms of Service state that they pay their publishers Net 90 after the end of each month. Now 90 days is certainly not a very fast payment cycle, but its what they offered and I agreed to it.

However it appears that they do not honor their own Terms of Service. I stopped using Mobclix on December 4, 2012 as they still had not made any payments to me that had met the Net 90 criteria for May, June and July.

We are now the end of March 2013 and I still have not received anything from them, with amounts overdue by 300 days.

Here is their response to my most recent attempt to contact them about it in early March 2013:
We have started issuing out August [2012] earnings in batches for those earning over $100+. You should expect a payment in the coming weeks if you’ve earning over $100+ during the August earning period.

August? Well what about my earnings from May, June and July? And what about the fact that everything up to the end of November meets the Net 90 day criteria?

They currently owe me over $2800, and I am also in touch with two other indie developers that are in a similar situation and are both owed over $2000 each.

We would like to start a class action suit against Mobclix, so please join the Mobclix Pay Us webste http://www.mobclix-pay.us/. There is also a SKYPE group (skype id: mobclixclassaction )  and Google Group you can join: https://groups.google.com/forum/?fromgroups#!forum/mobclix-class-action

Thanks

PS – Here are some of the responses I received from Mobclix when I asked about where my payments were:

October 25th, 2012 – “We issue payments on Net 90 (we’re running 2 months behind on net 90) of $100+. We will be issuing out June payments at the end of this month.”

December 4th, 2012 – “The invoices are being loaded as we speak.”

March 11th, 2013 – “We have started issuing out August earnings in batches for those earning over $100+. You should expect a payment in the coming weeks if you’ve earning over $100+ during the August earning period.”

April 1st, 2013 – Here are PDF versions of the sample letter and invoice that I sent to Mobclix at the beginning of April. Please note that I am not promising this will work and there is no guarantee it will work… I am simply sharing what worked for me.

Free SMS to Email – Sending a text message to an email address

My current cell phone plan with Virgin Mobile Canada has unlimited outgoing texting, but I don’t have a data plan, so I am unable to send a text message to an email address. Sometimes I find the easiest way to send myself a reminder is to text it to my email address, and then I can forget about it and it is waiting for me when I get back to my computer.

While searching the web for a free SMS to Email solution, and I came across this one:
http://www.world-text.com/services/emailgw/smstoemail.php

Now the only downside is that it’s a United Kingdom number, which may be an issue for some of you, but fortunately for me, my unlimited outgoing texting includes international numbers as well Canadian numbers at no extra cost.

So I simply send a text messge like this:

To: oo1447937985001

Message: my.email.address@mydomain.com This is the message I want to send!

And that’s it! Please leave a comment if this was helpful, and don’t forget to checkout CallCentric the Number One rated VoIp provider:

TotalFinder gives you Windows style “Folders On Top” on Mac OS X

As I have mentioned before, I have been using Windows as an operating system for as long as it has been around, so with my switch to an Apple MacBook Pro a few months ago, I have been on a never ending search to find ways of adding the Windows features that I miss most to OS X Lion! Well I have just discovered another one, which comes in the form of TotalFinder by Binary Age .

One of my dis-likes with OS X Lion is how Finder (equivalent of Windows Explorer on Windows) displays files and folders in List view. If you choose to sort them by “Name”, it mixes the folders in with the files. You can group the folders together and sort then by “Kind” instead, but then your files are sroted and grouped by file type and not by name. This is the main reason I decided to download and try TotalFinder (which offers a 14-day free trial).

I downloaded it, installed it, ran it and then went to Finder > Preferences and clicked on the “Folders On Top” option under the Tweaks tab, and immediately my ongoing annoyance with OS X was finally solved! 🙂

So I solved one problem and re-couped another missing Windows feature, but almost immediately I realized the benefits of another cool feature offered by TotalFinder: Tabs! With my usual workflow, I usually end up with 3 or 4 Finder windows open, all on top of one another, making it kind of difficult to navigate from one to the other. With TotalFinder Tabs feature, all your finder windows stay in the same window, and you can just click on a tab to quickly navigate between them.

And this leads to the next great feature they offer, called Dual Mode. A quick double-click on a tab, and you now have two finder windows open side by side which make is really easy for comparing content and/or copying and moving files around between different directories.

The last feature I will mention is the ability to add a “Copy Path” action to the context menu. There have been many times when I wanted to copy the full path to a particular file, but had to type it out by hand. This now makes it really easy to copy and paste the path whenever you need it.

I definitely encourage to take advantage of TotalFinder’s 14-day free trial and give this app a try. I think you will really enjoy it. You can get it from the Binary Age website here: TotalFinder

Toggle Show Hidden Files on Mac OS X

For some of us power users, wouldn’t it be nice if you could quickly show hidden files and then quickly hide hidden files again? Well now you can!

I have compiled the Apple Script below into an app, so you can download it and put it in your Applications folder and use it whenever you need it. There is also a Quick Launch app, which will add a little icon menulet in the top right menu bar, so you can quickly click on it to toggle between Show Hidden files and Hide Hidden files whenever you want:
DOWNLOAD HERE

In order for the Quick Launch app to work, you need to place both apps in your Applications folder. You can also add the Quick Launch app to “System Preferences > Users and Groups > Login Items” if you want it to start automatically when you turn on your computer.

Here is the Apple script used in the app:

if (do shell script "defaults read com.apple.finder AppleShowAllFiles") is equal to "0" then
do shell script "defaults write com.apple.finder AppleShowAllFiles 1"
else
do shell script "defaults write com.apple.finder AppleShowAllFiles 0"
end if
tell application "Finder" to quit
tell application "Finder" to activate

OS X Lion Mission Control – Houston We Have A Problem

As far as efficiency goes, there is really no easy way in OS X Lion to quickly see all my windows (visible, hidden and minimized) and then quickly switch to the one I want.

Mission Control + Hot Corner is almost awesome, but not quite!

The fact that I can quickly flick my mouse into a corner and have Mission Control pop up is great! It makes switching between Desktops very very easy and efficient. It also makes switching between currently visible application windows on the current desktop very very easy as well. Unfortunately the fact that it shows only the visible windows (and not the hidden or minimized ones) for the current desktop, considerably reduces it’s usefulness.

Wouldn’t it be great if I could use Mission Control to quickly and easily switch to ANY application window (visble/hidden/minimized) on ANY desktop? Well you cannot do that as far as I can tell! So the only solution I can come up with, is to send Apple some feedback and hope somebody reads it and sympathizes with my plea! Here are the links where you can report the request:

http://www.apple.com/feedback

https://bugreport.apple.com   (this might require a developer account, but try it anyways)

And just copy and paste the following:

PROBLEM #1 with Mission Control:
Does not have option to show minimized or hidden apps as well.
It would be great if there was an option for all hidden and/or minimized applications to show up along the bottom of the mission control screen.
This bottom area could be re-sizeable so you can make the area bigger or smaller to determine the preview size of these hidden/minimized applications windows.
You could then quickly open mission control and choose any application on your current desktop within a second or two… very quick, very easy, very efficient.
The only alternative I have found is to move my mouse all the way to the dock icon, two-finger click, move to the application window I want to open in the list and click it… this process is very very time consuming and annoying.
I know you can also uncheck the Minimize Applications To Dock Icon but I use a tiny dock and that means I have to hover over each little application icon one at a time to figure out which one I want. Once again, very time consuming and annoying.

PROBLEM #2 with Mission Control:
There is no way to see application on another desktop without clicking on the other desktop and making it active/focus.
There needs to be an option so that when you mouse over a desktop window (without clicking) that it instantly brings up all the application windows for that desktop. This way I can quickly move my mouse from desktop window to desktop window and find the application I am looking for very quickly.
This would allow you to quickly locate an application window amongst all your desltops, which is very easy and efficient.
Currently I have to click on a desktop window which brings that desktop to the foreground/focus and then see if the application I wanted is in that desktop or not… if its not there, I have to go back to Mission Control and go from desktop to desktop until I find the application window I was looking for.

SUMMARY:
Need to add the following options to Mission Control to make it truly awesome:
Option #1-Show Hidden Windows on Mission Control
Option #2-Show Minimized Windows on Mission Control
Option #3-Mouse Over Desktop Window shows Instantly Shows Windows for that Deskop.

Thanks

Windows PC style Minimize All Windows and Show Desktop on Mac OS X

UPDATE April 9, 2012
I have compiled the Apple Script below (March 23, 2012 update) into an app, so you can download it and put it in your Applications folder and use it whenever you need it. There is also a Quick Launch app, which will add a little icon menulet in the top right menu bar, so you can quickly click on it to Show Desktop whenever you want:

In order for the Quick Launch app to work, you need to place both apps in your Applications folder. You can also add the Quick Launch app to “System Preferences > Users and Groups > Login Items” if you want it to start automatically when you turn on your computer.

UPDATE March 23, 2012
Ok, so now I have found and even better solution, which is back to an AppleScript, but works even better than the ShowDesktop app below!

Go here an scroll down to the answer by Daniel Beck:
http://www.superuser.com/questions/36504/minimize-all-in-mac-os/403099

Open automator and choose new application and then drag Run AppleScript from the left side to the right side and add the following AppleScript then save it as an application… that’s it!

tell application "Finder" to activate
 tell application "System Events"
  tell application process "Finder"
   tell menu bar 1
click menu item "Hide Others" of menu of menu bar item "Finder"
click menu item "Minimize All" of menu of menu bar item "Window"
   end tell
  end tell
 end tell

Everything below is no longer necessary.

UPDATE March 20, 2012
Ok, I finally found somebody who has figured out how to do this correctly with instantaneous showing of desktop just like on Windows … they are genius!! Check out Everyday Software for their Show Desktop product and send them a $5 donation because it’s worth it!

UPDATED: January 3, 2011
New and improved script that will start closing windows in all applications simultaneously.

Having used Windows XP for 10+ years, I always had a little Show Desktop icon down in the bottom left in the quick launch bar (keyboard shortcut is WindowsKey+D and WindowsKey+M also works). Clicking it would instantly minimize all my open windows, and reveal my desktop underneath.

Mac OS X Lion does not have an exact duplicate of this feature. It does have F11 and the 4-finger up-swipe, but these sort move the windows to the side and you can see them around the edges. The Command+Option+ClickOnEmptySpotOnDesktop I think works ok, except it requires you to hold down Command key and the Option key and then you need to find an exposed piece of the desktop to click on.

So here is my best effort… it’s an AppleScript that will finds all the open windows and minimizes them. This would be perfect except that it takes a few seconds for it actually do it as you watch each window disappear one by one. If anybody has a solution to make this faster, let me know!

So first we will open up Automator (it’s in your Launchpad) and choose new Application. Then under Actions, you will drag the Run AppleScript action over to the right side of the screen. You will then copy an paste the AppleScript below, and save your application. You can put it anywhere you want, and then drag it to your Apple Dock so it’s available to click whenever you want.

Here is the new and improved AppleScript:

set blackList to {} –The processes in this list will be skipped. Example: “com.apple.Finder”, “Finder”

–NOTE: This section will start minimizing windows of each application at the same time.
tell application “System Events” to set processList to (bundle identifier of every process whose visible is true) as list
repeat with processName in processList
–display dialog processName –DEBUG only
if contents of processName is not in blackList then
tell application id processName
ignoring application responses
set miniaturized of (every window whose ((miniaturizable is true) and (miniaturized is false) and (visible is true))) to true
end ignoring
end tell
end if
end repeat

–NOTE: This section is required in case there are applications (like Finder, Automator, Calculator) that will not minimize using the Application ID method above
tell application “System Events”
repeat with appProc in (every application process whose visible is true) — Get all the available applications that are visible
–display dialog (get name of appProc) –DEBUG only
if (get name of appProc) is not in blackList then
click (first button of every window of appProc whose role description is “minimize button”) — From the available applications above, click on the minimize button of every window that has a minimize button
end if
end repeat
end tell

Here is the OLD script .. do NOT use this one:

−−This is the OLD script .. don't use this one!!
tell application"System Events"
−−Get all the available applications that are visible
repeat with appProc in (every application process whose visible is true)
−−From the available applications above, click on the minimize
−− button of every window that has a minimize button
click (first button of every window of appProc whose role description is "minimize button")
end repeat
end tell

Let me know what you think!
